Massachusetts Harassment and Stalking Laws 

Cyber harassment is punishable under Massachusetts’ criminal harassment and criminal stalking laws. Criminal harassment is the act of intentionally annoying or alarming another person through a pattern of conduct, including electronic communications. It can include making threats, following someone, sending unwanted emails or texts, and other forms of communication that can be considered harassing in nature. The punishment for criminal harassment can include a fine of up to $1000 and 2-6 months in jail. Subsequent offenses can carry sentences of up to 10 years. 

Criminal stalking involves engaging in a course of conduct that places another person in fear for their safety. This can include repeatedly following them, making repeated phone calls or messages, spying on someone even after being asked to stop, and other activities that could be considered stalking behavior. Those convicted of criminal stalking can face up to $1000 in fines and 2-6 months in jail or up to 5 years in prison. If the offense occurs when a restraining order is in place, penalties will increase accordingly, and subsequent offenses can carry a sentence of up to 10 years.
